GENERAL TERMS AND CONDITIONS OF CONTRACTING AND USE

1 – Ownership of the Alexandra Matias Jewellery brand and the www.alexandramatias.com domain

Alexandra Matias Jewellery is the trade name used by the company Fonte de Valores, Unipessoal, Lda., registered under corporate and registration number 510 156 371, with share capital of €5,000 and registered office at Rua Castilho 59B, 1250-068 Lisbon, Portugal, and will be used in these General Terms and Conditions to identify the aforementioned company.

The website www.alexandramatias.com is the property of Alexandra Matias Jewellery.

2 – Purpose and Scope

These General Terms and Conditions of Contracting and Use apply to visitors to the website www.alexandramatias.com and to any commercial transactions conducted through the online store available there.

Accessing and using the website and purchasing any product implies acceptance of these General Terms and Conditions of Contracting and Use by the User and/or the Customer.

Alexandra Matias Jewellery reserves the right to amend these terms of use and contracting, in whole or in part, without prior notice.

3 – Use of the Website

To make purchases through this website, you must first identify yourself.

4 – Intellectual and Industrial Property

All texts, comments, works, illustrations, creations and images reproduced or represented on the website www.alexandramatias.com are strictly reserved under copyright law and intellectual property rights. Accordingly, use is authorised only for private purposes and, even in such cases, subject to the restrictions laid down by law. Any total or partial reproduction or representation of the website's content is prohibited.

Company names, trademarks and distinctive signs reproduced on the website are protected under the applicable legal provisions on industrial and intellectual property. Any reproduction or representation, in whole or in part, without written authorisation is prohibited.

5 – Liability

Alexandra Matias Jewellery takes the necessary measures to ensure the accuracy of the information included on the website. However, it accepts no responsibility for errors or omissions in its content, or for any that may occur as a result of the temporary or permanent inability to use or access information, products or documents included on the website.

The content of the websites may be changed, in whole or in part, at any time without prior notice.

The user accesses and uses the website at their own risk, assuming full responsibility for issues inherent in its use, including viruses and other problems that may occur with their software or hardware.

6 – Customers' and Users' Obligations

Purchasing products by persons under 18 years of age is prohibited. It is also prohibited to enter, store or disseminate through the website any defamatory, obscene, insulting or xenophobic content, or content of any other kind that violates general principles of law and public order;

Customers and users undertake to:

a) keep their password for accessing the site's reserved area secure and not disclose it to third parties,

b) Not use false identities;

c) provide accurate personal details and addresses;

d) complete the registration forms fully and accurately, provide truthful information and enter any changes thereto.

Alexandra Matias Jewellery accepts no liability for any delay in or inability to process and deliver orders resulting from errors or insufficient information provided by the Customer.

Alexandra Matias Jewellery also accepts no liability for failure to deliver orders to countries subject to trade embargoes imposed by Portugal or the European Union.

7 – Orders:

To place an order, the User must add items to the shopping cart, edit the quantity of the items and complete the purchase.

Placing an order constitutes the User's full and complete acceptance of the prices and descriptions of the products available for sale, as well as the terms of sale set out in these Terms and Conditions.

Once the order has been completed and the corresponding price paid, Alexandra Matias Jewellery will send the Customer an email confirming the order.

Even if it has accepted the order under the preceding paragraph, Alexandra Matias Jewellery makes delivery of the products ordered and compliance with the relevant delivery times subject to stock availability. If the products are out of stock, Alexandra Matias Jewellery will contact the customer, preferably by email, to advise them of the new delivery time or, if the product is exclusive, suggest an exchange for a similar product, if available. If the customer does not agree to the exchange or the new delivery time, they may choose to purchase another item or receive a refund of the amount already paid, which will preferably be issued using the same payment method.

In the event of objectively verifiable errors detected on the website concerning products, their descriptions and images, and their respective prices, the parties undertake to restore the contractual balance as if the error had not occurred. This shall be done by the party who benefited reimbursing the injured party for any amounts received in excess or, if this is not possible, by cancelling the order.

In any event, Alexandra Matias Jewellery shall not be liable in any way for any direct or indirect damages resulting from delivery delays or the unavailability of the ordered item.

8 – Delivery:

Orders are delivered by a carrier engaged by Alexandra Matias Jewellery to the address provided by the Customer, which may not be a PO box or hotel. Shipping is free for the Customer.

Without prejudice to the provisions at the end of point 7 above, Alexandra Matias Jewellery will endeavour to ensure delivery within 3 to 10 working days, depending on the destination, from the day after payment of the order is confirmed, unless otherwise notified in writing.

If the order is sent to the address specified in the order, the Customer is responsible for all losses arising from failure to collect it.

9 – Cancellation:

Within 14 days of confirmation of the relevant payment, you may cancel the order, provided you do not use the product and deliver the purchased product to Alexandra Matias Jewellery’s premises within that period.

To do so, you must contact Alexandra Matias Jewellery Customer Service to request a Return Authorization Number to include with the return.

The cancellation of the order will only take effect if the returned products are in the same condition as when delivered, that is, without damage or wear of any kind.

If the ordered products have already been dispatched, Alexandra Matias Jewellery will refund the amount corresponding to the price paid once the customer has returned the products, less the amount spent on postage.

Engraved or modified items cannot be returned or exchanged.

10 – Payment:

Products may be paid for using the various electronic payment methods available at any given time.

11 – Price:

The prices of the products in force at any given time – which Alexandra Matias Jewellery may change whenever it sees fit – are displayed in euros and include VAT in force on the date the order is paid.

The Customer is responsible for all costs associated with any customs duties payable.

12 – Applicable Law and Jurisdiction:

All purchases made on the website www.alexandramatias.com are subject to these General Terms and Conditions and, subsidiarily, to Portuguese law.

Any dispute arising from purchases made through the website that the parties are unable to resolve amicably shall be settled by the competent court in the District of Lisbon.
